Much of the discourse in the bioethics literature on what is often called “cesarean delivery on maternal request” has focused on balancing respect for patient autonomy with attention to the short- and long-term risks of this procedure to maternal and neonatal well-being. And while there has been some analysis of the social and economic costs inherent in performing cesareans, much of the clinical and ethical analysis has concluded that, given the degree of risk to the mother and neonate from a (...) primary or single repeat cesarean delivery, there is sufficient justification for pregnant women to request and obtain this procedure from obstetricians willing to meet such requests. However, these same analyses often caution that physicians should not offer these elective cesareans to all women, but only to those who initiate the request. This paper analyzes recommendations that do not promote universal access to these procedures and concludes that such a policy is ethically unjustifiable, as it treats women who do not inquire about such procedures differently. Depriving appropriate candidates—for example, healthy women who are good surgical candidates and desire only one or two children—of information about elective cesarean delivery is a form of undue influence on women's decision-making. Van der Pijl et al outline data suggesting an alarmingly high incidence of violation of the bodily integrity of patients in labour, including episiotomies performed without patients’ consent, or over their explicit objection.1 Similar data have been reported from the USA and Canada.2 The authors appropriately conclude that explicit consent is required at the time of all invasive obstetrical procedures, including episiotomy. Commonsense adjustments to the duration and detail of consent under conditions of clinical urgency are appropriate and should be (...) familiar to any clinician involved in perinatal care, as well as non-obstetric proceduralists caring for acutely ill patients. Survival after solid-organ transplantation has improved significantly, and many contemporary transplant recipients are of childbearing potential. There are limited data to guide decision-making surrounding pregnancy after transplantation, variations in clinical practice, and significant knowledge gaps, all of which raise significant ethical issues. Post-transplant pregnancy is associated with an increased risk of maternal and fetal complications. Shared decision-making is a central aspect of patient counselling but is complicated by significant knowledge gaps. Stakeholder interests can be in conflict; exploring these tensions can (...) help patients to evaluate their options and inform their deliberations. We argue that uniform, evidence-based recommendations for pregnancy after solid organ transplantation are needed. The amount of money available to spend is never adequate to pay for everything you wish you could spend it on, therefore you must set spending priorities. There are two questions you need to be able to answer . . . How should we set priorities in this organization? How do we know when we (...) are doing it well? When people seek to achieve good public policy, the result will tend to be good public policy. In a collective choice process, public‐spirited individual participants produce good public policy by deliberating—talking with each other, listening to each other's arguments, and being willing to learn and change their minds based on such dialogue. –Steven Kelman (1992: 181) Public policy scholars agree that those persons (or agencies) vested with the authority to establish health care priorities should elicit public input before making rationing decisions. The two most common approaches are (i) consultation and (ii) deliberation. Though deliberation has obvious advantages over consultation, it falters in the face of the objection that ordinary citizens lack the cognitive resources for the extended, rigorous inquiry required of them in undertaking the priority‐setting task. To overcome this objection, I propose that deliberative forums for health care rationing should be designed so that they imitate the natural pattern of human experience. The experience of deliberation should encompass both prolonged periods of less‐demanding cognitive activity, in which citizens passively receive information, and briefer periods of more‐demanding cognitive activity, in which they engage in active problem‐solving. In arguing for this thesis, I rely on two theoretical sources and one practical case study, in the following order: (i) John Dewey's metaphysics of experience, (ii) cognitive science research on schemas and frames, and (iii) the Health Care Council in São Paulo, Brazil. The DNA hypomethylating agents (HMA) azacitidine (AZA) and decitabine (DAC) improve survival and transfusion independence in myelodysplastic syndrome (MDS) and enable a low intensity cytotoxic treatment for aged AML patients unsuitable for intensive chemotherapy, particularly in combination with novel agents. The proposed mechanism of AZA and DAC relies on active DNA replication and therefore patient responses are only observed after multiple cycles of treatment. Although extended dosing may provide the optimal scheduling, the reliance of injectable formulation of the drug limits (...) it to intermittent treatment. Recently, an oral formulation of AZA demonstrated significantly improved patient relapse free survival (RFS) and overall survival (OS) when used as maintenance after chemotherapy for AML. In addition, both DAC and AZA were found to be highly effective to improve survival in elderly patients with AML through combination with other drugs. These recent exciting results have changed the therapeutic paradigm for elderly patients with AML. In light of this, we review current knowledge on HMA mechanism of action, clinical trials exploring dosing and scheduling, and recent HMA combination therapies to enhance efficacy. (shrink)

It has been claimed that Massimi’s recent perspectival approach to science sits in tension with a realist stance. I shall argue that this tension can be defused in the quantum context by recasting Massimi’s perspectivalism within a phenomenological framework. I shall begin by indicating how the different but complementary forms of the former are manifested in the distinction between certain so-called ‘-epistemic’ and ‘-ontic’ understandings of quantum mechanics, namely QBism and Relational Quantum Mechanics, respectively. A brief consideration of Dieks’ perspectivism (...) will then lead to a consideration of the much-maligned and typically dismissed role of the observer in the measurement process. This opens the door to London and Bauer’s presentation of a form of ‘phenomenological quantum perspectivalism’ that brings together Massimi’s two forms and explicitly eschews the ‘naïve’ realism that creates the above tension. I shall conclude with some reflections on how intersubjectivity can still be established within this framework, focusing in particular on how Massimi’s idea of ‘interlacing’ scientific perspectives can be accommodated, using the example of a ‘new cosmopolitanism’ that gave rise to Bose-Einstein statistics. Donald Davidson has two central aims in his celebrated paper ‘Mental Events.’ First, he argues for the impossibility of ‘strict … laws on the basis of which mental events can be predicted and explained’ (ME, 208). I shall call the resulting view ‘mental anomalism.’ Second, he argues, based partially on this impossibility, for a version of monism which holds that every (causally interacting) mental event is token-identical with some physical event. This second aim puts constraints on how the argument for (...) mental anomalism can plausibly proceed. That argument cannot assume anything that presupposes monism or adversely affects the argument for it. When elaborated, this constraint by itself rules out otherwise attractive conceptions of how the argument for mental anomalism works. More generally, in order to be compelling, the overall argument for anomalous monism ought not to incorporate excessively controversial presuppositions even if they do not themselves beg any questions about monism. The argument needs to be built upon relatively intuitive premises. (shrink)

This essay argues that much can be gained from a close examination of Nietzsche’s work with respect to education. In order to contextualise my argument, I provide a brief critique of Nietzsche’s thinking on aesthetics, educators and education. I then turn my attention to the work of Thus Spoke Zarathustra, the figures Zarathustra and the Übermensch, and other Nietzschean works with a view to outline what I mean by a Nietzschean education. My central thesis being that a Nietzschean education is (...) primarily concerned with the cultivation of the self. This is certainly not an easy undertaking as it requires both an educator and education that can reveal to students “what one is” now, and who they could become. In order to bring this about, Nietzsche employs the use of an aesthetic model in the form of an exemplar for students to aspire to become. Here, the exemplar plays an important educative function in Nietzsche’s thinking because the role of the ideal type is to unsettle the student so that they are inspired to attain their unattained self that they recognise in the other. Consequently, what makes my account of a Nietzschean education significant is due to its concern with fostering timeless educational aims, such as learning to see, think, speak, write, and feel, by unsettling students with an ideal educator and true education so that students can get a sense of who they are now and who they could become. This paper takes an ontological approach to the subject of promising. Setting aside the typical concern over promissory obligations, I draw on recent work from the field of social ontology and develop a promissory schema that characterizes the functional role the practice of promising plays in our lives. This schema, put in terms of one agent’s voluntary and intentional attempts to provide another agent with a specific kind of assurance, helps explain what we are doing when we make a promise, (...) and what we desire when we ask that a promise be made. The promissory schema is explanatorily beneficial as it can help us understand why certain actions may be interpreted as promises, thereby reminding us that we need to be sensitive to the ways our actions can give rise to expectations in others. The Nèiyè 內業 talks of “a heart-mind within a heart-mind” that is somehow connected to or prior to language. In the context of the overall advice on looking “inward” or “internally” as part of the meditation and mysticism practice that the Nèiyè introduces, this talk of a heart-mind within a heart-mind arguably invites comparisons with a Cartesian “inner theater” conception of mentality. In this paper, I examine the “inner” talk of the Nèiyè in order to tease out its identifiable commitments (...) in philosophical psychology. I consider the ways in which the “inner” talk of the text might be read as marking out one or more of three different inner/outer distinctions, and I argue that we can consistently read the Nèiyè without seeing it as marking any inner/outer distinction that is related to what is often referred to in English as “inner experience.”. What is a scientific theory? This book considers this fundamental question by presenting a range of options and the issues they raise. It draws comparisons between theories and artworks and proposes that we should stop thinking of theories as things altogether.

Psychophysics measures the attributes of perceptual experience. The question of whether some of these attributes should be interpreted as more fundamental, or “real,” than others has been answered differently throughout its history. The operationism of Stevens and Boring answers “no,” reacting to the perceived vacuity of earlier debates about fundamentality. The subsequent rise of multidimensional scaling (MDS) implicitly answers “yes” in its insistence that psychophysical data be represented in spaces of low dimensionality. I argue the return of fundamentality follows from (...) a trend toward increasing epistemic humility. Operationism exhibited a kind of hubris in the constitutive role it assigned to the experimenter’s presuppositions that is abandoned by the algorithmic methods of MDS. This broad epistemic trend is illustrated by following the trajectory of research on a particular candidate attribute: tonal volume. (shrink)

The explanatory/pragmatic-trial distinction enjoys a burgeoning philosophical and medical literature and a significant contingent of support among philosophers and healthcare stakeholders as an important way to assess the design and results of randomized controlled trials. A major motivation has been the need to provide relevant, generalizable data to drive healthcare decisions. While talk of pragmatic and explanatory trials could be seen as convenient shorthand, the distinction can also be seen as harboring deeper issues related to inferential strategies used to evaluate (...) causal claims regarding medical treatments. A comprehensive, critical analysis of the distinction and underlying epistemological framework upon which the distinction is based, particularly with respect to treatment effectiveness, has yet to be forthcoming. I provide this, analyzing the distinction’s relationship to generalizability and cognate distinctions between ideal conditions and real-world practice, internal and external validity, and efficacy and effectiveness. I also analyze recent philosophical work that relies on the explanatory/pragmatic-trial distinction and that advocates for more pragmatic trials. I conclude that as an organizing principle for trial-design decisions and trial evaluation, the explanatory/pragmatic-trial distinction is conceptually problematic and not as useful as its proponents seem to think. Since some pragmatic-trial features can be inimical to establishing treatment effectiveness, pragmatic-trial features should not be conflated with pragmatic trials’ avowed goals. If the distinction is to be useful, it and some associated concepts, including generalizability, should be reformulated, lest they continue to underlie a medical epistemology that could contribute to methodologically flawed and potentially unethical advice for the design and interpretation of trials. Bovine tuberculosis is a controversial animal health policy issue in England, which impacts farmers, the public, cattle and badgers. Badgers act as a wildlife reservoir of disease. Policy options for badger control include do nothing, badger culling, and badger vaccination. This paper argues for mandatory Animal Welfare Impact Assessment for all policy that significantly affects sentient animals. AWIA includes species description, and AWIA analysis stages. In this paper, AWIA is applied to impacts of bovine TB policy options on cattle and (...) badgers. Over 4 years, 85,000 badgers will be culled to prevent the slaughter of ~17,750 cattle over 9 years. Hence, about five badgers are culled for every cow which avoids slaughter. The AWIA analyses the impact of badger vaccination on cows and badgers based on a set of stated assumptions. The AWIA estimates badger vaccination to reduce the number of cows slaughtered by 11,600, i.e. a 12.5% reduction. Additional to the harm of killing, culling has greater welfare impacts on badgers compared to non-culling options. Actors in animal health and welfare policy were interviewed about the concept of AWIA. Policy actors supported the idea of AWIA to provide objective data to feed into policy making. The paper concludes with the proposal that AWIA is a necessary stage of just policy making where sentient animals are impacted by government policy. (shrink)

This paper explores communicative punishment from a non-idealized perspective. I argue that, given the specific racial dynamics involved, and given the broader social and historical context in which they are embedded, American policing and punishment function as a form of racially derogatory discourse. Understood as communicative behavior, criminal justice activities express a commitment to a broader ideology. Given the facts about how the American justice system actually operates, and given its broader socio-political context, American carceral behaviors express a commitment to (...) the same types of derogatory, subordinating anti-minority ideologies that are paradigmatically conveyed through racial slurs and similar forms of derogatory speech. Moreover, I argue, this derogatory meaning presents a significant obstacle to adequate criminal justice reform. (shrink)

What is the relation between the intention to A and doing A intentionally? It is natural to suppose that the latter entails the former. That is, it is natural to accept what Michael Bratman has called the ‘Simple View’ of the relation between acting intentionally and having an intention. Bratman is one noteworthy writer who has denied that the Simple View is true. In the present paper I do not defend this view. I contend that one well-known argument that Bratman (...) offers for thinking that the Simple View is false fails, in fact, to disprove it. If there are reasons for thinking that the Simple View is false, as I believe there are, they are not the ones that Bratman has offered. My discussion of Bratman also raises some more general questions about the principles governing the rational formation of intentions. I suggest that a special sort of example casts doubt on the tenability of a commonly accepted principle that Bratman, among others, utilizes. (shrink)

The view that quantum particles cannot be regarded as individuals was articulated in the early days of the 'quantum revolution' and became so well-entrenched that French and Krause called it 'the Received View'. However it was subsequently shown that quantum statistics is in fact compatible with a metaphysics of particle individuality, subject to certain caveats. As a consequent it has been claim that there exists a kind of underdetermination of the metaphysics by the physics which in turn has been used (...) to motivate a form of 'notice' structural realism. In this essay I will review this purported underdetermination and the motivation for structural realism that it purportedly provides in the context of recent developments in both the philosophy of physics and metaphysics. I aim to conclude that such developments reinforce the underdetermination and allow one to respond to certain critical concerns regarding its motivational power. (shrink)

This groundbreaking study explores the ways young Americans today understand right and wrong, how they think out their morality, and how they live it out. It describes contrasting ethical styles in the biblical, utilitarian, and personalist traditions of our culture; first, as they structured the conflict between mainstream and counterculture during the 1960s, and second, as they have shaped the transformation of these values in new religious movements since the early 1970s. Coupling descriptive ethics with interpretive sociology, this study pursues (...) biography and moral dialogue with sixties youth who participated in a charismatic Christian sect, a Zen Buddhist meditation center, and a human potential organization (est). It shows the significance of these movements for the adherents' changing ideas of their own identity; their relationships, sex roles, courtship, and marriage; and their politics and vision of society. It analyzes the cultural logic and the social location of their ideas, which break down, recombine, and find renewal in the course of conversion. (shrink)

Bovine tuberculosis is the most economically important animal health policy issue in Britain. The problem of what to do about badgers has plagued successive governments since a dead badger was discovered with bovine TB in 1971. Successive Labour governments oversaw the Randomised Badger Culling Trial from 1998 to 2006. Despite the RBCT recommendation against culling, the 2010–2015 Coalition government implemented pilot badger culls. This paper provides an account of the evolution of bovine TB and badger control policy, focusing on the (...) 1997–2010 Labour, the 2010–2015 Coalition and the 2015-present Conservative governments. Interviews with bovine TB policy stakeholders supplement discussion of the development of bovine TB policy. The paper discusses the science and politics of bovine TB policy, in which there are different badger control policies in Westminster, Welsh and Scottish governments. Badger control is a highly polarised issue, and the Coalition and Conservative governments have been heavily criticised for a culling policy opposed by the independent scientific community. Recent governments have defended badger culling on the basis of veterinary advice and experience in countries such as New Zealand. The paper concludes with two key recommendations to inform controversial animal health and welfare policy issues such as bovine TB. First, mandatory Animal Welfare Impact Assessment provides objective data on the impacts of policy options on cows and badgers. Second, robust ethical analysis, conducted by independent experts using established moral frameworks, should be applied to animal health and welfare issues for the benefit of decision makers.
